Employment law update for the charity sector

Following the General Election on 4 July, Siobhan Mulrey and Mitchell Roberts of Bevan Brittan LLP will take a look (82 days after the Election) at what has changed in employment law, what is on the horizon, and what this means for in-house lawyers working in the charity sector.

1. A new duty to prevent sexual harassment in the workplace

Siobhan will focus on the Worker Protection (Amendment of Equality Act 2010) Act 2023 which comes into force on 26 October 2024 and introduces a duty for all employers to take “reasonable steps” to prevent sexual harassment of employees. Siobhan will cover:

• The legal context behind sexual harassment – how the Equality Act 2010 defines it and who is held responsible
• What the new duties mean for employers
• What is classed as ‘reasonable steps’ to prevent sexual harassment
• The practical steps organisations can take to comply

2. Impact of a new government on employment law for the charity sector

Mitchell will cover the first 100 days of a new government and beyond in relation to on employment law, including:

• An analysis of proposed employment law changes to trade union rights, new day one rights, pay, family friendly rights, fire and rehire and worker status
• The potential impact on employers and employment practices
• Actionable steps to ensure compliance and readiness

Q&A with Siobhan and Mitchell

Your speakers

Siobhan Mulrey is a Legal Director specialising in employment law. Since qualification in 2011, Siobhan has supported employers in all areas of contentious and non-contentious employment and HR matters, with a particular interest in complex settlement negotiations, board level disputes, trade union recognition and negotiations and strategic advice on large-scale redundancies and restructures. Siobhan acts for a wide range of employers in the commercial sector, as well as charities/not for profit organisations, the education sector and independent health and social care organisations.

Mitchell Roberts is an Associate in Bevan Brittan’s employment team. Mitchell is experienced in advising on all aspects of employment law, but with a specific expertise in litigation. Mitchell has acted for both UK clients and international clients, including USA and Canadian companies in the tech and life sciences sectors, as well as a variety of NHS Trusts and police forces. Mitchell also has experience acting for senior executives in the financial services sector and regularly facilitates interactive training sessions for clients and contacts.
